By surprise and one day in advance, as the vote was scheduled for Friday, the House passed yesterday afternoon in the bill CISPA. With a 248-168 vote in favor of and pending its passage by the Senate, the regulation is worse than writing a few days ago. Finally CISPA is a "blank check" for the government to act on data in the network of any city in the country.
And is that even a few hours ago the term "cyber security" was the basis of the proposal.Throughout the term the government could ask for and share private data with business users and third parties. ISPs and other companies operating in the network had access to each user's data and then report to government agencies or related companies upon request. A vagueness in the writings that during the past week debating the limits and uses.
Finally, it is much worse. The surprise vote yesterday followed the debate on the amendments, some of which were approved. Foremost, the definition of what the government can do with the information shared. No limit has been specified as it would limit the government's actions.
Surprising that it has voted a law one day in advance whose foundations were being discussed. Not only that, add a series of dangerous definitions.
CISPA previously allowed the government to use information across the term "cyber security" for "national security". The approved law is not only limited but have added three more uses:
Investigation and prosecution of cybercrime.Protection of persons.Protection of children.Although it may seem logical, adding "cyber crime" is defined in the literature as any crime involving interruption in the network, hacking or piracy in addition to any violation of the CFAA.
CISPA therefore misses the point by which he was born, the regulation that sought to "cyber-security," a mixture of the worst of SOUP with additions. Now the government would be able to find any information under CISPA without any citizen of the country have complete immunity or protection of privacy if it is argued that there is a "crime in cyber security."
With the law in their hands the Fourth Amendment would lose its status in the digital map and the government could do whatever he wants with the data whenever you can say that there is "danger".
With CISPA approved removes all privacy laws that are involved with technology in the network. A direct attack on the freedoms of users in the United States will now have to pass the Senate, when Mr. Obama may decide to veto or not.
If the Patriot Act gave full powers to the country on any citizen in the world covered by the term "terrorism", the U.S. government get with CISPA encompass everything that happens on the network. Internet already has "its" law in the U.S. and the last word has its president.
